Terms of Service
Effective Date: April 1, 2026 · Last Updated: March 29, 2026
We wrote these terms in plain language on purpose. NursingHomeIQ exists to help families make one of the hardest decisions of their lives. You deserve to know exactly what we are, what we are not, and what you can count on from us.
1. Who We Are
NursingHomeIQ is operated by IntermodeEd, LLC, a North Carolina limited liability company.
Mailing address: PO Box 163, Lexington, NC 27295
Contact: info@nursinghomeiq.com
2. Acceptance of These Terms
By accessing or using NursingHomeIQ.com (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time. When we do, we will update the effective date above. Continued use of the Service after changes are posted means you accept the updated terms.
3. What NursingHomeIQ Is — and Is Not
What it is
NursingHomeIQ provides synthesized intelligence reports about Medicare- and Medicaid-certified nursing facilities in the United States. Our reports draw on publicly available data sources including CMS Care Compare, inspection records, staffing data, ownership records, and complaint histories. We process and synthesize that data into plain-language summaries, trend analyses, and IQ scores designed to help families make more informed placement decisions.
What it is not
NursingHomeIQ is not a substitute for professional medical, legal, or financial advice. Our reports are informational only. We are not licensed healthcare providers, attorneys, or financial advisors. Nothing on this site should be construed as a recommendation to place or not place any individual in any specific facility.
We are also not affiliated with, endorsed by, or acting on behalf of any nursing facility, healthcare system, government agency, or insurance provider.
The honest limitation
Public data has limits. CMS inspection cycles are infrequent. Staffing data is self-reported. Ownership records can lag. Complaints are underreported. Our IQ scores and summaries reflect the best interpretation of available public data at the time of compilation — they are a starting point for your research, not a final verdict.
4. Data Sources and Accuracy
Our reports are built from publicly available government data. We refresh our data monthly. Between refresh cycles, reported conditions at a facility may change in ways our scores do not yet reflect.
We make reasonable efforts to ensure accuracy but cannot guarantee that the data underlying our reports is complete, current, or free of error. Government datasets themselves contain errors, omissions, and processing delays that are outside our control.
You should treat our reports as one input among several — including your own facility visits, conversations with staff and residents, and advice from discharge planners, social workers, and healthcare providers.
5. Payments and Pricing
Single report
A single facility report is available for a one-time fee. Payment is processed at the time of purchase. Your report is made available immediately upon successful payment.
Multi-report access
We offer a limited-access option that provides reports for up to 30 facilities during a 30-day access window. Access begins at the time of purchase. Unused report credits do not carry forward after the 30-day window expires.
Monitor subscription
Where offered, a monthly monitoring subscription provides ongoing alerts when a tracked facility's data changes materially. Subscriptions are billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period.
Pricing changes
We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed.
6. Refund Policy
Because our reports are delivered digitally and immediately upon purchase, we generally do not offer refunds once a report has been accessed.
If you experience a technical failure that prevents you from accessing a report you paid for, contact us at info@nursinghomeiq.com within 7 days of purchase and we will make it right — either by resolving the access issue or issuing a full refund.
We stand behind our data. If you believe a report contains a material factual error, contact us. We will investigate and, where an error is confirmed, provide a corrected report or a refund at our discretion.
7. Prohibited Uses
You agree not to use NursingHomeIQ for any of the following:
- Scraping, harvesting, or systematically downloading data or reports in bulk
- Reselling, redistributing, or republishing report content without written permission
- Using report data to contact, solicit, or market to nursing facilities or their residents
- Any purpose that violates applicable federal, state, or local law
- Any use that could harm the reputation or operation of a facility based on inaccurate or misleading use of our scores
Violation of these restrictions may result in immediate termination of your access without refund.
8. Intellectual Property
NursingHomeIQ reports, IQ scores, plain-language summaries, and underlying synthesis methodology are the intellectual property of IntermodeEd, LLC. The underlying government data from which reports are derived is public domain.
You may print or save a report for your own personal, non-commercial use. You may share a report with family members involved in a placement decision. You may not publish, reproduce, or distribute report content commercially or for any purpose other than personal family decision-making without our written consent.
9. Privacy
We collect only the information necessary to provide the Service — payment processing data (handled by our payment processor, not stored by us), search queries, and email addresses where provided. We do not sell your data. We do not share your data with nursing facilities or any third party except as required by law or necessary to process your payment.
Our full Privacy Policy is available at NursingHomeIQ.com/privacy.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any report or data provided through the Service.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the maximum extent permitted by applicable law, IntermodeEd, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you for all claims arising from your use of the Service exceed the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless IntermodeEd, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. Arbitration shall take place in Davidson County, North Carolina.
You waive any right to participate in a class action lawsuit or class-wide arbitration against IntermodeEd, LLC.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. If we terminate your access for reasons other than a violation of these Terms, we will refund any unused paid access on a pro-rated basis.
